These terms and conditions shall apply to all agreed regular collections of commercial waste and construction waste. Here is everything you need to know about hiring and using our bin services ordered through our website and/or digital platforms. When you place an order with us, the details of which are specified on the Order, you agree to be bound by these terms and conditions (the agreement).
Use of Auckland Construction Services Group Limited subject to terms and conditions of sale.
Your access to and use of Auckland Construction Services Group Limited is subject to the following terms and conditions of sale. By using Auckland Construction Services Group Limited you represent that you have read, understood and accepted these terms and conditions, and agree to be bound by them. Orders placed through the Auckland Construction Services Group Limited constitute legal offers to purchase and are capable of being accepted by Auckland Construction Services Group Limited without any further reference to the Customer.
Definition and Interpretation
- Bin means the bin that we supply to you
- Trading Name means our legal business is Auckland Construction Services Group Limited and we trade under Auckland Construction Services Group Limited. This will appear on cardholder for any transactions made through this website.
- Charges means the rates and any other charges that is stated in the Order and as otherwise incurred in accordance with the agreement
- Clean Fill Waste means broken concrete, rocks, bricks, asphalt, clay, sand, soil, dust, dirt and ceramic tiles. The “clean” in clean fill means that the waste is not contaminated by any other forms of waste and excludes Prohibited Materials and General Waste
- Prohibited Materials means any item, substance or liquid that is explosive, hazardous, illegal, dangerous, a fire hazard or which we are not permitted to transport including as specified and any material which we may advise you from time to time is excluded.
- Excluded Material Charge means the administrative charge per Bin emptied, payable by you if a Bin contains prohibited material and if your bin is contaminated
- Excess Collection Weight means Bin over the specified weight allowance will incur an additional charge
- Insolvency Event means you cease carrying on business, become or are likely to become insolvent or an arrangement or compromise is made with your creditors, or a receiver, liquidator, administrator or statutory manager (or any other similar official) is appointed to you or you are adjudicated bankrupt
- Notifiable Event has the meaning given that term in the Health and Safety Code
- Order means the order for services completed by you and generated on our website at the time you place your order with us. Once your order has been received and confirmed by Auckland Construction Services Group Limited you will be bound by a contract to purchase the services requested by that order, subject to your rights to cancel and/or vary the order set out of these terms and conditions either verbally or in writing.
- Services means the type of Waste and Materials collection services identified in the Order as may be varied by mutual agreement
- Service Address means your address specified on the Order and any other site added by mutual agreement from time to time
- GST means goods and services tax chargeable in accordance with the Goods and Services Tax Act 1985.
- Term means the hire period specified in the Order. The supply of bins and services by Pink Bins is governed by these terms and conditions, which may be amended from time to time.
- We, us and our means Auckland Construction Services Group Limited Workers has the meaning given that term in the Health and Safety Code
- You and your means the customer named on the Order
Making orders
When you place an order with us, you agree to use our services on a regular, ongoing basis until you cancel. You will need an email address that you check regularly, as this is how we will communicate with you.
Delivering your bin
Please kindly select the relevant bins so that we will deliver your bin within five working days of payment and confirmation of your order

All Auckland waste bins should not be filled any higher than the top of its side and should be filled in a good manner to prevent spillage of material from the bin.
Scheduled collections
We will empty your bin on the scheduled collection date, or within two working days after your scheduled collection date, unless we have let you know in advance by email or text message that the date has changed. Where your scheduled collection falls on a public holiday your collection day may change.
Charges
Our prices is determined by the service address you provided to us, or as per agreement at time of opening an approved trade account. All prices are quoted based on the delivery address given at the time of placing your order, so any change to your address may result in a different price being charged.
Payment
Payment by Cash, Cheque or Credit Card (Visa or MasterCard) on delivery of the bin or for Trade clients with a credit account on the 20th of the month following. Failure to make payment on the agreed terms may incur a penalty interest of 1.5% per month from the due date to actual date of payment. Any expenses, costs or disbursements incurred by Auckland Construction Services Group Limited in recovery or attempted recovery of overdue money, including credit collection agency and/or solicitor costs shall be paid by you in full.
Cancellation of Delivery or Variation of your order
You are entitled to cancel or vary your order prior to delivery of the bin, provided you do so with enough notice (24 hours) to prevent dispatch of an unwanted bin to your site. Cancellation or variation after dispatch or delivery will incur a charge
Pick up
If you require a change in the agreed date for the pick up of your bin, you must notify Auckland Construction Group Limited’s office with enough notice (24 hours) to prevent any unnecessary trip to your site. Failure to do so may incur an additional charge.
Use and Care of Bins Whilst on your site
- While you have a bin on your site, you must not:
- Move the bin without Auckland Construction Services Group Limited’s consent. Should
- you do so and we are unable to pick up the bin within a reasonable timeframe onsite or within the agreed rental period, you may be charged for additional time for our driver on pick up and/or truck towing costs where applicable and additional onsite rental costs.
- Do not fill bin past level (i.e. top of bin) and do not move bins on site, any bin requiring salvage (i.e. is unretrievable after being moved without permission) or any damage caused on retrieval is at hirers expense.
- Fill any bin higher than level with the top of the bin, or fill it in such a manner to cause spillage of its contents on pickup or in transit
- Place in the bin any prohibited materials or chemicals – including but not limited to asbestos, liquid paint, solvents acid, oil or liquid concrete. Any damage to persons or property from prohibited and hazardous substances may be reported to OSH.
- Light fires in the bin
- Mix hardfill and general rubbish in the bin.
Waiver
If any time Auckland Construction Services Group Limited does not enforce any of these terms or grants you at the time indulgence, we will not be construed as having waived that term or its rights to later enforce that or any other term.
Money back guarantee
If we are not able to deliver your bin or collect your waste, we will refund you the charge for your missed service. To claim your money back, please let us know within 5 working days of your missed service, by contacting us through our website.
Prohibited Materials
If you have signed up for Construction Waste services, the following additional terms apply:
- Please ensure your Commercial and Construction Waste only contains approved waste. We cannot accept ammunition and fireworks, aerosol canisters, LPG and CNG cylinders, oxyacetylene and other welding cylinders, compressed air cylinders for scuba diving, diesel, flammable liquids such as petrol, kerosene, methylated spirits turpentine, thinners, solvent-based paints and epoxy resin, hardener for epoxy resin, some swimming pool chemicals, some commercial and household cleaning products such as dishwasher detergents and some garden care products.
- Please do not put any light fires, or place hot embers or hot ash in the bin. Also do not put any liquids or explosive, toxic, dangerous, hazardous or noxious materials in the bin. This includes materials like asbestos, acids solvents, paints, unwrapped broken glass, minerals, grease or cooking oil, or concrete
- In some areas you may be able to order extra collections in addition to your scheduled collections by contacting us in advance. These extra collections will be charged for at the rates applicable at the time. If you arrange for an extra collection, you cannot postpone your next regular collection. Extra collections may not be able to be ordered for any week in which there is a public holiday. You will be informed of the scheduled date for extra collections in your area when you contact us
- If any general rubbish is found mixed with hardfill, general rubbish rates and weight limits will apply.
- Allow the waste in your bin to exceed 50kgs.
Garden Waste
If you have signed up for Garden Waste services, please ensure your Garden Waste bin only contains approved organic waste. We cannot accept bamboo, flax, dirt or soil, rocks, household rubbish, newspaper, old compost, cooked food, woodchips or stumps or branches bigger than 100mm in diameter in the Garden Waste bin. Bins containing any forbidden material will not be taken as this cannot be composted successfully. An additional charge will apply if forbidden material is found in the bin.
Liability
You will be liable to us for any damage to our bins whilst in your possession, fair wear and tear excluded, and for any liability we incur as a result of you not complying with these terms.
Making Changes
Changes to Terms: Auckland Construction Service Group Limited may alter these terms at any time, notification of the changes will be made on our website and in writing to Trade Customer. From time to time we may need to change these terms, including adding new ones. We want to make sure we’re acting reasonably and in good faith. If any changes we make could have a detrimental impact on you, we will give you at least 28 days’ notice of the change by emailing you and publishing the change on our website. Continuing to use our services after being notified in this way indicates you accept the changes. If you do not agree to the changes, you have the right to terminate this agreement.
- Changes to Charges: We may change our prices from time to time. When we increase the prices for your services we will give you 28 days’ notice by emailing you and publishing the changed prices on our website.
- Changes to Services: We may change our services from time to time. If the change is within our control, we will provide you 28 days’ notice of such alterations by emailing you and by publishing the change on our website.
Privacy
You authorize us to collect, keep and use personal information you provide to us to process payment for our services, or for any other purpose that you authorize. We comply with the Privacy Act 2020, and you have the right to access and correct any personal information we hold about you (there may be a reasonable charge for this).
Client’s responsibility
- To ensure acceptable placement, access must be at least 3.0 meters wide. Bins must be placed on clear flat land and cannot be lowered over fences or obstacles. Bins are not permitted on the road or on footpaths unless a permit from the Council is obtained. Bins placed on site are not re-positioned. Auckland Construction Services Group will not be liable for any damage caused to the property when re-positioned by you.

Access for Collection and Drop Off
- It is your responsibility to ensure our access to the collection site is clear and the collection point is flat for our vehicle bins collection and drop off, and to make sure that the bin is placed in the right location. If our collection vehicle is required to enter your property, the driveway access must be at least 3.0 meters wide. If our employee or vehicle are not able to access to collect or drop off the bins, we may charge a travelling cost of a minimum $200.00 plus GST. We may also charge an additional fee for waiting onsite until you provide an acceptable cleared access at a rate of $150.00 plus GST per hour. 1-hour minimum charge applies.
- If you or your authorized representative is not onsite, our employee is entitled to place the bin at an acceptable location and placement as we see fit.
- If our employee cannot find an acceptable placement of the bins, our employee may wait until you come onsite and advise where to place the bins. We may charge additional fee for waiting onsite at a rate of $150.00 plus GST per hour. 1-hour minimum charge applies.
- We may elect not to collect or drop off the bins on site if our employees believe that it is unsafe to do so or such access to collection or drop off may cause damage to our vehicle. We are not responsible for your costs or losses if the works are not completed under this clause.
Private Road Damages
- You are responsible for and will indemnify us for:
- Any damage on the private road or the property on site caused by our vehicle; and
- Maintenance of your private road and any damages that covers your property.
General Terms and Conditions
- In these Terms, “us” “our” or “we” means Auckland Construction Services Group Limited (the owner of this website), and “you” means our customer, who purchases services from us on this website. The Trade Waste Agreement prices are as set out in the Council’s current standard fees and charges as provided on the Council’s website
- Severability: If any portion of these terms is deemed to be invalid, illegal or unenforceable the remaining provisions shall remain in full force and effect
- Governing law: These terms will be governed by New Zealand law and you agree to submit to the exclusive jurisdiction of the New Zealand Courts
